DUID
If you have been charged with a DWI involving drugs (DUID), or Driving Under the Influence of Drugs, there are serious consequences associated with the penalties. The typical tests that are administered – sobriety and Breathalyzer tests – cannot determine if the individual is under the influence of a drug. In order to help prove that you are innocent, you must hire a New Jersey DUID attorney.
If you are suspected of driving under the influence of drugs (DUID), such as a narcotic or any other habit forming drug, charges will be brought against you. Certain drugs that can affect driving ability are marijuana, cocaine, heroin, LSD or any prescription narcotic.
There is no requirement to provide a urine, blood or breath sample if you are stopped by police when they suspect DUID. These tests, as determined by the New Jersey Law of Implied Consent, are limited to suspicion of alcohol impairment, not drugs. If you have a commercial license, you are required to pass a chemical test.
A special Drug Recognition expert would be responsible for administering a chemical test and if that person was unavailable, the results of your test would not be admissible in a court of law.
