Suspended License

During a normal traffic stop, it doesn’t take long for an officer to determine that the person is not driving with a valid driver’s license – typically because it has been suspended for one reason or another. In many instances, a New Jersey Criminal Attorney may find it easy to help with this situation – other times it can be quite difficult. It really depends on the reason behind the suspension.

If you’ve received too many points on your license and it’s been suspended by the DMV, they must show that they communicated to you fairly and in a timely manner. If you were not aware that your license was suspended and they can’t prove differently, your New Jersey Drivers License attorney may still be able to prove your innocence.

Severe penalties will be assessed against an individual who is found guilty of driving while his/her license is suspended. There is a $500 fine for the first offense followed by a yearly $250 surcharge which you will have to pay for three years. You will be responsible for a cost of $1,250 payable to the DMV. The second offense incurs a $750 fine with 5 days in jail. Third offenses incur a fine of $1,000 and 10 days in jail.

If an injury is the result of an accident caused by a driver operating a vehicle without a valid license, you face a minimum of 45 days in jail.

Your New Jersey Suspended License attorney will be faced with a much more difficult case if your license was suspended due to DWI and you’ll be faced with stiffer penalties. These suspensions occur in the courtroom; therefore DMV does not have to prove they notified you of your suspension because at that point you should have been aware of the actual suspension. You will be fined an additional $500 and the license suspension will be extended another one to two years and you could face 90 days in jail.
