Ignition Interlock Device

The reason an ignition interlock device is installed into a car is to ensure that the person attempting to drive is not intoxicated. In order to drive the car the driver must blow into the mouthpiece on the device in order to be able to start and drive the car. The car will not start if the device reads a certain BAC level in New Jersey and that level is 0.05%.

While driving the car you will need to give another reading in order to prevent others from breathing into the device and allowing the individual to drive away once the car has been started. If you do not do another breath test, the car will record the incident, set off an alarm, the lights will flash, the horn will start blowing until the driver has turned the key off. Most people think that the car will shut off if it does not receive another breath sample but it will not as this would be dangerous to you and other people that are on the road.

In New Jersey if you are convicted of a DWI you could be subject to the following:

  1. First DWI offense in NJ. An ignition interlock device will be installed into your car for six months to one year.
  2. Second DWI offense In NJ. You will receive either a two year suspension of registration privileges or an ignition interlock device in your car for one to three years.
  3. Third DWI offense in New Jersey. A ten year suspension of registration privileges, or the ignition interlock device for one to three years as a condition for restoring your driving privileges.
  4. If you are convicted of a DWI and the court ruling states you have to have an ignition interlock device installed in your car you will receive a notice of suspension and instructions on how to have the device installed.
